6. SPECIAL PERMIT APPLICATION For Outdoor Storage and Display – Submitted by Home Depot for property known as 440 Boston Post Road. For the outdoor storage and display of seasonal items & merchandise.

7. APPLICATION FOR MIXED USE DEVELOPMENT WITH AFFORDABLE HOUSING UNITS AS PER 8-30G OF THE CT GENERAL STATUTES – Submitted by Sixty Five Marsh Hill Road, LLC for property known as 65-69 Marsh Hill Road and 0 and 15 Salemme Lane (Proposed Orange Train Station).

The mixed use development has underground parking, commercial and residential components. Sixty apartments are proposed. There will be 18 Affordable Units. A SITE PLAN APPLICATION has been submitted. (Continued from the February 21, 2017 meeting.)

There is a problem with a resident on Old Grassy Hill Road who did not comply with the building plans that he’d been permitted.

3.  Review and discussion concerning Orange Transit Oriented Audit & Strategy Options (study), possible changes to the TODD Regulations, & possible changes to the Orange Zoning Map.  Discussion will also concern the Moratorium on TODD zone change applications.

PUBLIC HEARING

4.  *SPECIAL PERMIT APPLICATION FOR THE CONVERSION OF A SINGLE FAMILY DWELLING TO ACCOMMODATE AN ELDERLY APARTMENT.

For property known as 422 Ridgeview Road, Orange, CT.  Submitted by property owner Donald & Nicole Feuerstein.  To create an elderly apartment.  (Continued from the October 18, 2016 meeting).

A family of 5 wants to provide their older parents with a place to live where they can be close. The apartment will have a separate entrance.

The Feuersteins did all of their homework and received all of the variances that they needed. They came well prepared and the project was unanimously approved.

Zoning Enforcement Offier Paul Dinice was not in attendance.

Here are some notes from the meeting.

(Minor amendments were made to the Aug. 15 minutes and they were approved)

The subject property is shown as “0 Marsh Hill Road,” containing 8.091 acres, on Map #2369 on file at the Orange Town Clerk’s office, and is designated by the Orange Assessor as Map/Block/Lot 3-1- 1.

An APPLICATION FOR CERTIFICATE OF SOIL EROSION AND SEDIMENT CONTROL MEASURES has also been submitted in conjunction with this project.

Discussion:

Decorative elements added that gave the building more balance.

6. PETITION TO AMEND the Orange Zoning Map. Submitted by Orange Land Development LLC. To change the zoning designation of the subject property from LI-2/TODD Overlay to TODD. The submission includes a “concept plan” as required by the Orange Zoning Regulations.

Discussion/Presentation:

The site was previously used for greenhouses, which have been torn down.

The application is for a tractor supply store for the Screen Shot 2015-11-04 at 8.09.17 PM“gentleman farmer” will include carhart apparel, gates for livestock, parts for tractors, feed and medicines for livestock.

Plain includes a 19,097 sq ft building, 15,000 sq ft concrete pad for items that won’t fit inside the store.

Driveway would be off of Prindle Hill Road, proposed paint striping stating, do not block driveway.

The applicant is going before the Police Traffic Authority on Monday.

The new business will not generate a lot of traffic and will only need about 56 parking spaces, not the 91 that are currently required by the town regulations.

*6.  APPLICATION FOR TEMPORARY SPECIAL USE EARTH MATERIALS  REMOVAL & FILLING.  Submitted by John L. & Gloria Capecelatro/Mark Capecelatro, Trustee.  For property known as 253 Indian River Road.  Work is for required cut, fill & grading of earth materials in conjunction with the construction of a proposed 19,097 sq. ft. Tractor Supply Company retail store with associated parking.  An APPLICATION FOR CERTIFICATION OF  SOIL EROSION AND SEDIMENT CONTROL MEASURES has also been submitted.

Lights would not disturb neighbors and would be LED lights.

8.    APPLICATION FOR CERTIFICATION OF SOIL EROSION AND SEDIMENT CONTROL MEASURES.  Submitted by John L. & Gloria Capecelatro/Mark Capecelatro, Trustee.  For property known as 253 Indian River Road.  For the construction of a 19,097 sq. ft. Tractor Supply Company Retail Store with associated parking.

Discussion/presentation:

Any earth material that is dug up would be reused in another part of the lot.

Work most likely will be done in the spring of 2016, it will take about 4 weeks of work.

Commissioner Judy Smith asked if they would be willing to defer parking and have more green strips on the property.

A permit is not needed from Inland/Wetlands, All other required permits have been obtained, except for the Traffic Authority.

The business also would have a 500 Gallon propane tank for use as a filling station.

At 9:32 p.m. the Commission voted to keep the public hearing open until the next scheduled meeting.

Plan and zoning commission votes to impose fines.

The Planning and Zoning Commission voted unanimously tonight to begin fining an Edison Road property owner $150 per day for zoning violations that have long been a problem in that area.

Alexander Cuzzocreo, a reported representative for EJC LLC, which began a construction project on the site with no building or zoning permits.  EJC LLC is actually based in West Haven at 34 Prindle Drive.

Town Zoning Officer Paul Denice has been on top of this situation for several months. In his past zoning reports he’s said that there seems to be a chipping and mulching operation going on at the property, along with the construction of big storage bins. There are several trailers on the property as well.

Being so close to the Oyster River, the Commission is concerned about water safety issues too, and wonder if an inland wetland permit also is needed for the property.

The conversation regarding this situation has been going on for so long that it didn’t take the commission long to decide to fine EJC every day until the problem is resolved.
